  • The Business Innovation Stream is a temporary visa for successful business owners who want to own and manage a new or existing business in Australia. It can be the first step towards a permanent business migration visa.

  Criteria for business owners

To qualify for a Business Innovation and Investment (Provisional) (subclass 188) visa on the basis of your business career you must prove that:
 
  • you have had a successful business career
  • you managed one or more businesses rather than provided professional or trade services
  • over the prescribed period you business generated annual turnover of $500,000
  • you have (or had) an ownership interest in the business
  • you are committed to establishing or investing in an Australian business and need to be in Australia to conduct the business
  • you have total assets of at least AUD $800,000 (as at September 2012) that have been legally acquired and can be legally transferred to Australia
 You need to be aware that:
  • only certain types businesses can count towards your successful business career
  • your holding in the business (as a percentage of the total issued capital) must be at least 30% and often more than 50% of the total issued capital
  • how you establish your business can have a significant impact on your obligations under Australian law and your ability to satisfy the requirements attached to this visa
  • you must provide legal documents to prove that you own your assets / business, plus audited reports prepared to international standards to prove the turnover of your business and/or value of your assets.

Business Investor Stream Visa 188 (Provisional)
 
The Business Investor Stream is a temporary visa for people with a successful business or investment career who are able to make a designated investment Australian state or territory and who want to maintain business and investment activity in Australia once their designated investment matures.

 Criteria for Business investors

To qualify for a Business Innovation and Investment (Provisional) (subclass 188) visa on the basis of your investment career you must prove that:
 
  • you are less than 55
  • score 65 points on the business innovation test
  • you have had a successful career as an investor
  • you closely and carefully managed your investments for more than 3 years
  • during one of the last five fiscal years the investment you have carefully managed was worth $1,500,000
  • you have total assets of at least AUD $2,250,000 (as at September 2012) that have been legally acquired and can be legally transferred to Australia
  • you have made a designated investment of $1,500,000 which is held in government bonds for 4 years.

Common Criteria

Whether you are applying on the basis that you are a business owner, an investor you will need to prove that:
 
  • you (and any accompanying family members) have not been involved in unsuitable business activities
  • you  meet the health and character requirements
  • you are less than 55 years of age when you lodge the visa application, unless you are a significant investor
  • you score 65 points on the business innovation test.


Business Talent visa 132 (Permanent Visa)

The Business Talent visa is designed to attract the highest calibre business people to participate in the management of a new or existing business and live in Australia permanently

The Business Talent visa (subclass 132) is a permanent residence visa for business people who are nominated by an Australian state or territory government agency.

You, your partner, or you and your partner combined must have all of the following:
  • Total net assets of at least AUD 400 000 as the ownership interest in one or more qualifying businesses for least two of the four fiscal years immediately before you are invited to apply and if the qualifying business(es) was a publicly listed company, a shareholding of at least 10 per cent of the total issued capital 
  • net business and personal assets of at least AUD 1.5 million that are legally acquired and can be transferred to Australia within two years after the visa is granted
  • a total annual turnover of at least AUD3 million in one or more of your main businesses in at least two of the four fiscal years immediately before you are invited to apply

ownership of at least:
  • 51 per cent of a business with turnover of less than AUD400 000 per year
  • 30 per cent of a business with turnover of more than AUD400 000 per year, or
  • 10 per cent of a publicly listed company
  • an overall successful business career
  • no involvement in unacceptable business activities
  • a genuine desire to own and maintain a management role in a business in Australia.

You must also be younger than 55 years of age, although a state or territory can waive this requirement if your proposed business will be of exceptional economic benefit to the region where it will operate.

Investor 405

  • Investor Retirement Visa : A temporary visa for people aged 55 years or older who are able to make a significant long term financial investment in Australia. This visa is not a pathway to a permanent visa.      
Criteria

You must be 55 years of age or older. Your partner can be any age.You and your partner must not have dependent children or other dependent family members.You must have assets (or if you have a partner, your combined assets) valued at least AUD750 000.

The assets must be:
  • legally owned and lawfully acquired by you (or you and your partner)
  • capable of and available for, transfer to Australia.
Exception: If you intend to live in regional Australia you must have assets (or if you have a partner, your combined assets) valued at least AUD500 000.
  • Income
You (or combined with your partner) must have access to a minimum net income of AUD65 000 per year.
If you intend to live in regional Australia you (or combined with your partner) must have access to a minimum net income of AUD50 000 per year.
This income test applies each time you apply for an Investor Retirement visa (subclass 405). If you choose to reapply for your visa you will need to show that your net income still meets this requirement.

Designated Investment

You must have made a designated investment of at least AUD750 000 in your name (or in the names of you and your partner), in the state or territory in which you have been sponsored. The funds for the designated investment are in addition to your asset requirements.

If you intend to live in regional Australia you must have made a designated investment of at least AUD500 000 in your name (or in the name of you and your partner) in the state or territory in which you have been sponsored.

A designated investment must be maintained for the duration of the Investor Retirement visa (subclass 405). The amount of the designated investment decreases by  AUD 250 000 the first time you reapply for the visa and then remains constant thereafter. If you reapply for your Investor Retirement visa (subclass 405) a designated investment of AUD500 000 must be made and maintained. If you live in regional Australia a designated investment of AUD 250 000 must be maintained.
